Can I rent my ADU short-term in Massachusetts?

Updated October 2026

It depends on your town. As of October 2026, the state ADU law lets each city or town restrict or prohibit short-term rentals of ADUs. Brookline bans them in both the house and the ADU, and Newton sets a 30-day minimum rental term. A long-term lease is allowed under the state law in towns it covers.

What does the state law say?

The Affordable Homes Act protects the use and rental of an ADU from special permit requirements, but it leaves short-term rentals to local choice. As of October 2026, Mass.gov says towns may restrict or prohibit them.

How do the communities we serve handle it?

  • Brookline: its May 2026 bylaw says no short-term rentals are allowed in the primary dwelling or the ADU.
  • Newton: its April 2025 amendments set a minimum rental or occupancy term of 30 days.
  • Boston: Boston regulates short-term rentals under its own ordinance, separate from ADU zoning. The Pioneer Institute notes that the 2026 draft neighborhood zoning would allow ADUs in non-owner-occupied and short-term rental arrangements, but it was not adopted as of October 2026.
  • Quincy and Somerville: check the current local short-term rental rules before you plan around nightly income.

Are there state requirements for short-term rental hosts?

Yes. Massachusetts requires short-term rental operators to register with the Department of Revenue and collect the room occupancy excise. Local registration can apply on top.

Should I design for short-term or long-term use?

It depends on the rules where you live and how stable you want the income to be. Where short-term use is banned or limited, we design for a long-term tenant or a family member: durable finishes, real storage and a full kitchen. Changing a plan later costs more than choosing the right one now.
